These Terms of Service (“Terms”) govern your use of jemshah.com, Jemshah learner accounts, courses, lessons, downloads and any Jemshah mobile application that links to these Terms. Jemshah E-learning may also appear in mobile-app listings as JEMSHAH ONLINE LEARNING.
By creating an account, purchasing access or continuing to use the service, you agree to these Terms. If you do not agree, do not use the relevant service. These Terms should be read with our Privacy Policy and Disclaimer.
1. Educational service
Jemshah provides learning and revision resources that may include course notes, past examination papers, independent answer guides, mock questions, quizzes, videos, downloads and study tools. The content offered may vary by course, module, application and access plan.
2. Eligibility and learners under 18
You must be legally able to accept these Terms. A learner under 18 should use account, payment and communication features with the involvement and permission of a parent or legal guardian where required. A parent or guardian is responsible for supervising the child’s use of the service.
3. Accounts and sign-in
You agree to provide accurate information, keep your credentials secure and promptly notify us of suspected unauthorised access. You may not share, sell or transfer an account or use another person’s account without permission. You are responsible for activity carried out through your account unless caused by a failure for which Jemshah is legally responsible.
If you choose Sign in with Google, your use of that authentication service is also governed by Google’s applicable terms. You can review our handling of account information in the Privacy Policy.
4. Licence for personal learning
Subject to these Terms and any access conditions shown at purchase, Jemshah grants you a limited, personal, non-exclusive, non-transferable and revocable licence to view and use the available materials for your own learning and revision.
Unless a page or download expressly permits it, you may not reproduce, republish, sell, sublicense, upload elsewhere, distribute in bulk, remove ownership notices, bypass access controls or commercially exploit the materials. Reasonable printing or downloading for your own study is allowed only where the relevant feature is provided.
5. Intellectual property and examination materials
Jemshah owns or licenses its branding, website design, original explanations, answer guides, mock questions, videos, graphics, software and other original material, unless stated otherwise. Official past papers, institutional names, trademarks and examination-body materials remain the property of their respective owners. Their presence on Jemshah does not transfer ownership to Jemshah or to a user.
References to KNEC, CDACC, TVET institutions, colleges, universities or other bodies identify relevant qualifications or examinations. They do not imply endorsement or affiliation unless expressly stated.
6. Acceptable use
You must not:
- use the service unlawfully, fraudulently or to harm another person;
- upload malware, interfere with security, overload the service or attempt unauthorised access;
- scrape, harvest, copy or extract content at scale using automated tools without written permission;
- circumvent payment, enrolment, download or account restrictions;
- post infringing, deceptive, abusive or unlawful material;
- impersonate another person or misrepresent an affiliation; or
- use Jemshah content to create or sell a competing copy of the service.
7. Prices, purchases and access
Some resources are free and others may require a one-time payment or subscription. The price, currency, duration, renewal terms and access included should be displayed before you confirm a purchase. Please review that information and correct any error before paying.
For purchases made through Google Play or another third-party store, billing, renewal, cancellation and payment processing are also subject to that provider’s rules. Auto-renewing subscriptions continue only as stated on the purchase screen and can normally be managed through the store account used to subscribe. A one-time purchase or access plan lasts for the period described at purchase, subject to these Terms and any necessary legal or security action.
8. Refunds and payment problems
Refunds and cancellations are handled according to the information shown at purchase, the payment provider’s applicable process and Kenyan consumer law. Nothing in these Terms removes a mandatory right or remedy available under applicable law.
Contact info@jemshah.com promptly if you are charged more than once, pay but do not receive the stated access, or believe the supplied digital service was materially misdescribed. Include the transaction reference and the course or product involved, but do not send a password, PIN or full payment-card number. For a store purchase, we may direct you to the store’s refund or subscription controls.
9. Educational accuracy and examination outcomes
Jemshah works to provide useful material, but syllabuses, standards, timetables and examination requirements can change. Independent answer guides are revision aids and are not official marking schemes unless expressly identified as such. More than one method or answer may be acceptable in some subjects.
You remain responsible for checking important information against current notices from your institution, KNEC, CDACC or the relevant examining body. Use of Jemshah does not guarantee examination success, admission, certification, employment or any particular result.
10. Technical and safety information
Electrical, mechanical, construction, agricultural, health and other technical content is provided for education. It is not a substitute for approved drawings, current standards, manufacturer instructions, site-specific risk assessment, competent supervision or professional advice. Do not perform hazardous work solely from an online lesson.
11. User comments and submissions
You retain ownership of original material you submit. When you post material publicly on Jemshah, you give us a non-exclusive licence to host, display, reproduce and moderate it only as reasonably needed to operate and promote that part of the service. You confirm that you have the right to submit it. We may remove spam, unlawful material, personal data posted without authority, or content that violates these Terms.
Correction reports and private support messages are used to investigate and respond to the issue and are handled under our Privacy Policy.
12. Third-party services, links and advertising
The service may include Google Sign-In, analytics, advertisements, payment providers, embedded media and links to third-party websites or applications. Third parties operate under their own terms and privacy policies. An advertisement or external link does not by itself mean Jemshah endorses the product, service or every statement on the linked page.
13. Availability and changes to content
We aim to keep Jemshah available and useful but cannot promise uninterrupted or error-free access. Maintenance, security incidents, network failures or circumstances beyond reasonable control may cause interruptions. We may correct, update, reorganise or remove content, particularly where it is outdated, unsafe, unlawful or subject to a valid rights claim.
If a change materially affects paid access, we will handle the matter according to the purchase terms and applicable law.
14. Suspension and termination
We may restrict or suspend an account where reasonably necessary to protect users or the service, investigate fraud or security concerns, respond to legal requirements, or address a serious or repeated breach of these Terms. Where appropriate, we will provide notice and an opportunity to contact us.
You may stop using the service at any time and may request account deletion subject to legal retention duties. Ending an account does not automatically cancel a subscription billed by a third-party store; you must also cancel it through that store.
15. Copyright complaints and corrections
If you believe material infringes your intellectual-property rights, email info@jemshah.com with your name and contact details, the exact Jemshah URL, identification of the material, the basis of your claim and evidence that you own or may act for the owner. We will review sufficiently detailed, good-faith notices and take appropriate action.
For an academic error, broken link or outdated detail, send the exact page and question through email, our Contact page or the correction link shown on eligible lessons.
16. Disclaimers and limitation of responsibility
The service is provided with reasonable care and subject to rights that cannot lawfully be excluded. To the extent permitted by law, Jemshah does not warrant that every item will always be complete, current, error-free or available, and is not responsible for indirect or consequential loss that was not reasonably foreseeable from use of the service.
Nothing in these Terms excludes or limits liability, consumer rights or remedies where doing so would be unlawful. Please read the separate Disclaimer for important academic, professional and safety limitations.
17. Privacy
Our Privacy Policy explains the personal data we collect, the services currently used on Jemshah, advertising and analytics, retention, security and your rights.
18. Governing law and disputes
These Terms are governed by the laws of the Republic of Kenya, except where another law must apply. If a dispute arises, please contact us first so we can try to resolve it fairly. This clause does not prevent either party from using a regulator, consumer-protection process or court with lawful jurisdiction.
19. Changes to these Terms
We may update these Terms to reflect service, legal or security changes. The revised date will appear at the top. Material changes will be highlighted or otherwise communicated where reasonably required. Changes do not remove rights already accrued under applicable law.
